How long will my divorce take? Well, it depends

It is estimated that 13% of Florida adults are divorced. Though people may choose divorce for a variety of reasons, in Florida, there are two types. An uncontested divorce means that both parties are in agreement, and these sorts of proceedings may only take a few weeks. In the case of the other option, a contested divorce, the process may take several years to complete.

In order to qualify for an uncontested divorce, both parties must have reached an agreement on their own for all aspects involved. This includes matters such as division of property, alimony and child custody. These divorces may be final in a little more than a month.

Unfortunately, most divorces are not that simple and can take much longer to become final. If one or both parties decides to contest, it can be years before the case wraps up in court. Though many courts offer mediation, which may quicken the pace as parties try to reach an agreement on various issues, each party is allowed to have an attorney present.

Florida residents may do well to have an experienced attorney by his or her side through the divorce process. An attorney can help a client through the court proceedings or mediation. It can be difficult for two opposing parties to reach an agreement, and having knowledgeable legal representation can help a client stand fast in their decisions during the emotional process of divorce. Once a divorce is finalized, both parties can legally go their separate ways, with a court order in place to prevent future conflict.
